By accessing or using EatLift ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify you of material changes via email or through the app.

2. Description of Service

EatLift is a mobile fitness tracking application that provides:

  • Workout tracking and exercise library
  • Nutrition logging and meal tracking
  • AI-powered food scanning and nutrition label scanning
  • AI coaching and fitness guidance
  • Progress tracking and analytics
  • Fitness calculators and tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. Users under 18 must have parental consent.

4. Subscription and Payment

4.1 Subscription Plans

EatLift offers a Pro subscription plan at $9.99 USD per month. The subscription includes access to all features of the Service, including AI-powered features, advanced analytics, and premium content.

4.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

4.3 Billing Cycle

Subscriptions automatically renew each month unless cancelled. You will be charged on the same date each month based on your initial subscription date.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until the end of the paid period.

4.5 Refunds

Refunds are provided at our discretion and in accordance with applicable law. If you cancel within 14 days of initial subscription, you may be eligible for a full refund. Contact eatliftofficial@eat-lift.com for refund requests.

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Impersonate any person or entity or falsely state your affiliation
  • Upload or transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service or other user accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Share your account credentials with others
  • Reverse engineer, decompile, or disassemble any part of the Service

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you upload to the Service (workout data, meal logs, photos, etc.). By uploading content, you grant us a license to use, store, and process your content to provide and improve the Service.

6.2 Our Content

The Service, including all software, designs, text, graphics, and other content, is owned by EatLift and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

7. Health and Medical Disclaimer

IMPORTANT: EatLift is not a medical service. The information provided by the Service, including AI coaching recommendations, is for informational and educational purposes only and is not intended as medical, health, or fitness advice.

You should:

  • Consult with a healthcare professional before starting any exercise or nutrition program
  • Not use the Service as a substitute for professional medical advice
  • Seek immediate medical attention if you experience any health issues
  • Use the Service at your own risk

We are not responsible for any injuries, health issues, or other consequences resulting from your use of the Service.

8. AI Features Disclaimer

Our AI features (food scanning, AI coach, nutrition label scanning) are provided "as is" and may not always be accurate. The AI may:

  • Provide estimates rather than exact values
  • Make errors in recognition or analysis
  • Not recognize all foods or nutrition labels accurately

You should verify AI-generated information, especially for dietary restrictions or medical conditions. We are not liable for any errors in AI-generated content.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless EatLift, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. We may delete your account and data, though we will retain certain information as required by law.

12. Governing Law
